Calculating the Deadline for Filing a Trial Certificate

Dear Valued Client,

Please note the Supreme Court of British Columbia has released an important and helpful information sheet regarding calculating the deadline for filing a trial certificate, available here.

With respect to the consequences of a failure to file a trial certificate, the information sheet refers to Supreme Court Civil Rule 12-4(5) and Supreme Court Family Rule 14-5(5).  We would also like to refer you to Supreme Court Civil Rule 12-4(6) and Supreme Court Family Rule 14-5(6), which both state:

A party who fails to file a trial certificate under subrule (1) is not, without leave of the court, entitled to make further applications.
