Court of Appeal Launches Civil Rule Reform Consultation

The BC Court of Appeal has launched a Civil Rule Reform Consultation, seeking input from the public on "how the court’s civil rules are working for the people who participate in the court’s processes".

The announcement lists nine specific topics for discussion but stresses that they are just examples and that all rule reform ideas are welcome. These examples are:

  • a chronological reorganization of the rules
  • ways to reduce the volume of paper involved in an appeal
  • updates to costs rules
  • adjusting the powers of a single justice in chambers
  • consolidating the security for costs powers
  • changes to the list of matters requiring leave to appeal
  • broadening options relating to vexatious litigant orders
  • providing for motions to be disposed of in writing
  • changes to the filing schedule of an appeal

Feedback should be sent to [email protected] by March 31, 2015. The court encourages the public to "be as specific as possible about obstacles and inefficiencies you have experienced, as well as your vision for a fair and efficient system" and notes that this consultation deals only with the BCCA civil rules and that a consultation on the criminal rules will be conducted separately.
